Scope

‍

• These general reservation and terms and conditions, in the version available at the time of reservation, apply to the business relationship between Hühnerbraterei Poschner OHG and the customer. Conflicting or deviating general terms and conditions of the customer are not accepted.

‍

Reservation process

‍

• On our homepage www.poschners.de, you can send us a non-binding reservation request using our contact form.
• If your reservation request can be fulfilled, we will send you a reservation offer by email. This reservation offer includes an invoice with the payment request in the amount of the food vouchers, depending on the number of people and the reservation time.
• We are bound to the reservation offer by email up to and including 5 days after invoicing, i.e. you can accept this reservation offer by paying the invoiced amount. Your payment must be credited to our account no later than the 5th day after invoicing.
• If we do not notice receipt of payment in full within 5 days of invoicing, we will regard your reservation request as irrelevant and a reservation contract will not be concluded.
• Another reservation option is direct booking, where you can select your seats yourself, pay online and use them to book your seats yourself after our subsequent confirmation.
• Subject to approval and approval of Hühnerbraterei Poschner OHG for Oktoberfest 2026 by the state capital Munich, a binding reservation contract will be concluded upon receipt of payment in full and timely.
• A minimum purchase in the form of vouchers is required per reserved space and 1.50 euros per reserved space is charged to process the reservation and create the vouchers.
• The collective voucher is sent by e-mail as a QR code, therefore without shipping costs. All other, non-digital, minimum consumption vouchers are sent to you within Germany by express courier and calculated with the actual shipping costs (without surcharge).
• The vouchers are generally not sent abroad; the non-digital vouchers must be picked up at the main entrance in the party tent on the day of reservation.
• In the case of international transfers, all costs are borne by the customer, and the transfer must be ordered accordingly.
• If payment is received in full and on time, you will receive a confirmation of receipt by email. Vouchers will be sent to the postal address provided by you at the beginning of July 2026 at the earliest. The value of the minimum consumption is printed again on the food vouchers. You can choose from our full range of food and drinks à la carte. We require one meal per reserved seat.
• The reservation is valid for the time and number of people stated in the confirmation.
• Reserved seats must be taken up in full within 15 minutes from the specified time on the reservation date. Unoccupied seats, even at partially occupied tables, must be released and can be refilled by us with other guests. It is also possible to place more than one reservation together at a table. If you leave the tent during the reservation period, we reserve the right to re-enter. At the end of the confirmed reservation period, seats must be vacated and the tent must be vacated. For safety reasons, continuing in the corridors after this time is prohibited. Standing room is not permitted for fire safety reasons.
• Persons who are obviously intoxicated may be denied access — despite a valid reservation. Admission is subject to appropriate clothing. People wearing costumes may be denied entry.
• The voucher prices stated in the ARGB are gross prices, including statutory value added tax. It is not possible to report input tax on food vouchers, as the tax is based on the catering bill.
• For souvenirs and all other prices (e.g. shipping costs), the input tax statement is issued on the invoice issued in advance.

Storage of contract text/contract language

‍

• We save the contract text of your reservation. We will also send you a separate reservation offer with all reservation details and our general reservation and terms and conditions to the email address you provided. The contract language is German.

‍

Transferability

‍

• The customer undertakes and expressly assures to purchase the tickets exclusively for his own purposes.
• The seat reservation is valid exclusively for the customer and his guests.
• Reselling or auctioning reservations to third parties with the intention of making a profit is prohibited. These reservations are cancelled.
• For authentication, you must bring the confirmation of the reservation and present it to our service staff at the receipt. We are entitled, but not obliged, to verify the customer's identity on the basis of identity documents.
• The acquirer is permitted to transfer reservations for our party tent privately if the transfer is made via the Oktoberfest-Booking.com online exchange platform officially authorized by us (www.oktoberfest-booking.com) in the manner provided there or has been permitted by us in individual cases.

Cancellation and reduction of the number of people

‍

• Withdrawal from the reservation does not entitle you to exchange vouchers, unless the cancellation is attributable to Hühnerbraterei Poschner OHG.
• Cancellations and reductions in the number of persons of reservations must be made in writing. The processing costs for canceling invoices that have already been paid are 30% of the total minimum consumption amount until 30.06.2026 and 50% of the total minimum consumption amount. Only complete table reservations can be canceled.
• If the number of persons making the reservation changes, the customer is obliged to report this in writing immediately, but no later than 01.09.2026.
• From 02.09.2026 up to 3 days before the reserved date, the processing fee is 80% of the total minimum consumption amount, after which cancellation or reduction by the customer is generally excluded.
• A cancellation must be made in writing. Food vouchers that have already been sent must be returned to us at the same time. The postmark of the return of the vouchers is decisive for the cancellation date.
• You are expressly allowed to prove that no damage or a decrease in value has occurred at all or is significantly lower than the percentage lump sum.
• For pre-ordered menus, at least the number of ordered menus is calculated. A pre-order is binding and cannot be changed or withdrawn later for technical processing reasons. Cancellation or reduction of menu orders is therefore generally excluded. If the number of people is canceled, the value of the pre-order of the menu will be deducted from the cancellable amount beforehand.

Force majeure/self-delivery reservation

‍

• If the party tent operation cannot be carried out in whole or in part on the day of reservation due to official orders, security considerations, force majeure or other important reasons, the monetary value will be refunded at 20% of the voucher value/minimum consumption, minus the processing fee of 20% of the total amount. Further claims by the customer against Hühnerbraterei Poschner OHG are excluded in these cases. Explicitly also incurred travel and accommodation costs. Hühnerbraterei Poschner is entitled to withdraw from the contract if there are impediments to performance that cannot be overcome or if, despite existing agreements with suppliers in the sense of previously concluded, congruent cover transactions, it is not possible to deliver the necessary materials without the responsibility of Hühnerbraterei Poschner OHG.

• Hühnerbraterei Poschner OHG is entitled, taking into account the interests of the client, to change or deviate from the service owed in a manner that is reasonable for the client.

Applicable house law

‍

• The customer is not allowed to bring food and drinks intended for consumption in the party tent. No decorations or entertainment offers may be made (even by third parties) without the consent of Hühnerbraterei Poschner OHG. Hühnerbraterei Poschner OHG expressly reserves the right to exercise house rights.
• It is essential to follow the instructions of the security forces.
• For the safety of our guests, the tent is under video surveillance.

Data protection

‍

• Hühnerbraterei Poschner OHG is entitled to collect, store, process and use the customer's personal data. The customer expressly agrees to this. We are committed to complying with legal regulations on data protection. Customer data will not be passed on to other persons or other third parties. You can request that your personal data be deleted at any time.

Payment terms in the party tent

‍

• The catering bill resulting from actual consumption is due and payable immediately before leaving the party tent. The invoice amount is to be paid using the food vouchers. If the amount of the food is higher than the value of the vouchers, this must be paid by cash or card payment to the responsible service person. Any objections to the invoice amount or individual invoice items must be raised directly with the service employee or management — before payment. Subsequent complaints can no longer be considered.
• The place of fulfilment for the catering service and the place of payment for any additional consumption is Hühnerbraterei Poschner OHG, Wirtsbudenstraße 47, 80336 Munich.
• Invoices must be checked for accuracy by the guest in the tent. Subsequent corrections are not possible.

Validity of food vouchers

‍

• The food vouchers are valid for the duration of Oktoberfest 2026. Existing balances due to the purchase of vouchers can only be offset against the bills for the respective consumption in the marquee during the Oktoberfest 2026 period. It is not possible to settle in the following year. Vouchers will be accepted at a later date in compliance with the regulations of the state capital Munich.
• The original food vouchers are only valid during your reservation period and must be brought along on the relevant day, after which unused food vouchers can be redeemed for the duration of Oktoberfest from 19.09.2026 to 04.10.2026 in the party tent of the Poschner chicken roaster from Monday to Friday from 11 a.m. to 3 p.m. without the right to a reservation and in street sales for the duration of Oktoberfest 2026. Regulations of the state capital Munich. There is no provision for a refund of remaining amounts and cannot be used as a tip.

Choice of Law, Jurisdiction and Maintenance Clause

‍

• Only German law applies to the exclusion of the UN sales law. With regard to a consumer, this choice of law only applies to the extent that it does not restrict any mandatory legal provisions of the state in which he has his place of residence or habitual residence. The place of jurisdiction is our place of business, insofar as the client is a merchant, a legal entity under public law or a special fund under public law. The same applies if the customer does not have a general place of jurisdiction in Germany or the place of residence or habitual abode is unknown at the time the action is brought. Should individual provisions of the contract or these General Terms and Conditions be or become invalid, this does not affect the validity of the remaining provisions. The wholly or partially invalid provision should be replaced by a provision whose economic success comes as close as possible to the ineffective provision.
